📜 Rising Sun Electric – Detailed Terms and Conditions for Electrical Services

These Terms and Conditions (“Terms”) govern the provision of all electrical contracting, installation, repair, and maintenance services provided by Rising Sun Electric (“the Company”) to the customer (“Client” or “you”). By accepting a quote, signing a service agreement, or allowing work to commence, you agree to be bound by these Terms.

 

1. Scope of Work and Agreement

 

  • Service Agreement: The specific details of the work (e.g., job description, materials, estimated hours, price) are defined in the mutually executed Service Agreement or Quote Acceptance Form. These Terms supplement that agreement.

  • Exclusions: Unless specifically included in the Service Agreement, the scope of work excludes: patching or painting of walls, structural modifications (beyond necessary holes for wiring), or modifications to pre-existing hazardous conditions.

  • Client Responsibilities: The Client must provide the Company and its staff safe, clear, and timely access to the property and utility panels necessary for the work. The Client is responsible for securing any necessary internal HOA or landlord approvals.

 

2. Pricing, Payment, and Change Orders

 

  • Pricing: The price is fixed upon acceptance of the final quote, subject only to necessary Change Orders.

  • Unforeseen Conditions: If the Company encounters unforeseen conditions (e.g., hazardous materials, pre-existing defective wiring hidden within walls, unmapped utilities) that materially affect the scope or cost, the Company will notify the Client immediately. Work will stop until a written Change Order detailing the adjusted scope, cost, and time is agreed upon and signed by both parties.

  • Payment Schedule: Payment will be due according to the schedule specified (e.g., deposit, installment payments, final payment upon completion). Final payment is due immediately upon the completion of work and passing of final inspection.

  • Late Payment: The Company reserves the right to charge interest on overdue amounts at the maximum rate permitted by law.

 

3. Installation, Warranties, and Liability

 

  • Workmanship Warranty: The Company warrants that all electrical installation and wiring work will be performed in a professional manner, free from defects in workmanship, and in compliance with local electrical codes for a period of [Insert Period, e.g., one (1) year] from the date of final commissioning/inspection.

  • Equipment Warranty: All equipment (e.g., panels, fixtures, circuit breakers) is covered by the original manufacturer’s warranty only. The Company will assist the Client in submitting claims but does not provide a separate equipment warranty.

  • Limitation of Damages: The Company’s liability for property damage caused directly by the negligence of the installation process is limited to the reasonable cost of repair or replacement of the damaged area.

  • Consequential Damages Disclaimer: THE COMPANY IS NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, LOSS OF REVENUE, OR DAMAGE TO ELECTRONICS) ARISING FROM THE INSTALLATION, FAILURE, OR USE OF THE ELECTRICAL SYSTEM.

 

4. Code Compliance and Permits

 

  • Code Compliance: All work will be performed in compliance with the prevailing local, state, and national electrical codes (e.g., NEC).

  • Permits and Inspection: The Company will apply for necessary electrical permits as required by the local authority. The Client agrees to cooperate with the inspection process. The Company is not responsible for delays caused by the government or utility company inspection schedules.

  • Existing Conditions: The Company is not responsible for bringing pre-existing, non-conforming electrical systems up to current code standards unless specifically included in the scope of work.

 

5. Termination

 

  • Termination for Cause: Either party may terminate the agreement upon written notice if the other party materially breaches these Terms or the Service Agreement and fails to cure the breach within [Insert Days, e.g., ten (10) days] of receiving notice.

  • Client’s Termination for Convenience: If the Client terminates the agreement without cause, the Client must immediately pay the Company for all work performed, materials purchased, and all costs incurred (including permits and restocking fees) up to the date of termination.
